1. About These Terms

These Terms of Use govern access to and use of the Atri platform—including the mobile app, website, WhatsApp services, and all related services—operated by **Atri LTDA**, a Brazilian private legal entity (CNPJ 52.941.676/0001-83), headquartered at **Rua José Licínio Lopes, 1241, CEP 88070‑780, Canto, Florianópolis, SC**.

By using our Services, you fully agree to these Terms. If you do not agree with any provision, do not use the platform.

1.1 Important Definitions

  • Atri or Platform: The set of digital services offered, including the app, website, and WhatsApp bot.

  • User or You: An individual who uses Atri’s services.

  • Services: All features offered by Atri, including educational content, connection with professionals, and commercial intermediation.

  • Partner Professionals: Diabetes educators, registered nutritionists, registered physical educators, and licensed physicians who provide services through the platform.

  • Health Data: Information related to your health condition, including diabetes data, glucose, medications, and activities.

2. Nature of the Service

2.1 What We Do

Atri is an educational technology platform for diabetes and day‑to‑day routine support. We offer:

  • Organization and visualization of glucose data, monitored and processed by third parties, shared with the User’s consent.

  • Educational content on diabetes, routine, and healthy lifestyle.

  • Connection with licensed professionals (diabetes educators, CRM‑registered physicians, CRN‑registered nutritionists, CREF‑registered physical educators).

  • IIntegration with continuous glucose monitoring (CGM) devices, wherein:

    • Atri is not the primary processor of these data.

    • Atri is not responsible for alerts or critical monitoring.

    • Atri does not generate recommendations for medical decisions.

  • Communication channel via WhatsApp for educational support and routine guidance.

  • Technological tools to improve day‑to‑day management.

  • Intermediated sale and delivery of diabetes‑related supplies via pharmacy partners.

2.2 What we DO NOT do:

Atri is NOT a medical service. Specifically, we do not:

  • Perform medical diagnoses.

  • Prescribe medications or treatments.

  • Request medical exams.

  • Issue medical certificates, reports, or prescriptions.

  • Provide emergency care.

  • Replace medical appointments or professional follow‑up.

  • Make medical or critical health decisions.

IMPORTANT: In cases of medical emergency, severe symptoms, severe hypoglycemia, or hyperglycemia, seek urgent medical care immediately or contact your doctor. Our Services do not replace professional medical care.

3. Eligibility and Account

3.1 Requirements

To use our Services, you must:

  • Be at least 18 years old.

  • Reside in Brazil.

  • Provide true and up‑to‑date information.

  • Have the legal capacity to enter into contracts.

For those under 18:

  • Consent and supervision by legal guardians is required.

  • Guardians are jointly responsible for use of the platform.

  • Minors’ data receive additional protection under the LGPD.

3.2 User Account

Required information:

  • Full name;

  • Valid e-mail;

  • Phone/WhatsApp number;

  • Date of birth;

  • Basic diabetes information;

  • Address (for product delivery);

  • Tracking devices data.

Optional information:

  • CPF (for specific integrations)

  • Communication preferences.

3.3 User Responsabilities

Account safety:

  • Keep credentials secure;

  • Do not share login;

  • Notify us immediately of unauthorized use.

Information accuracy:

  • Provide true, updated data;

  • Update when necessary;

  • Do not create multiple accounts for the same person;

  • Do not use others’ identities.

4. Subscription and Payment

4.1 Subscription Model

Services are offered under semiannual or annual contracts with automatic renewal unless canceled.

4.2 Prices and Billing

  • Prices are available on our website/app.

  • Billing occurs every 30 days during the subscription term.

  • Prices may change with at least 30 days’ prior notice.

  • All charges include applicable taxes.

4.3 Automatic Renewal

Your plan renews automatically for the same term unless you cancel at least **24 hours** before the end of the current period.

4.4 Cancellation

  • You may cancel at any time via the app or by contacting us.

  • Cancellation takes effect at the end of the current billing period.

  • We do not offer prorated refunds for cancellations.

4.5 Right of Withdrawal

Under the Brazilian Consumer Defense Code (CDC), you have **7 calendar days** from contracting to withdraw without cause, with a full refund.

5. Use of the Services

5.1 License

We grant you a limited, non‑exclusive, non‑transferable, revocable license to:

  • Access and use the platform in accordance with these Terms.

  • Download and use the app on your personal devices.

  • Access educational content for personal use.

  • Interact with professionals via the platform.

5.2 Restrictions

You may not:

  • Use the platform for commercial purposes without authorization.

  • Reproduce, distribute, or modify content without permission.

  • Attempt to access unauthorized systems or data.

  • Interfere with the platform’s operation.

  • Use unauthorized bots or automated scripts.

  • Send spam or malicious content.

  • Infringe intellectual property rights.

  • Use the platform for illegal activities.

  • Share third‑party credentials (e.g., medical device passwords).

5.3 User Content

  • You retain ownership of content you share with us.

  • You grant us a license to use such content as needed to provide the Services.

  • You are responsible for the truthfulness and legality of content provided.

6. Integrations and Third‑Party Devices

6.1 CGM Devices and Platforms

Our Services may integrate with third‑party devices and platforms (Apple Health, Android Health, Garmin Connect, LibreView, Dexcom, etc.) to generate reports and daily‑routine views for educational purposes.

6.2 Responsibilities

  • You are responsible for authorizing these integrations.

  • We follow each third‑party platform’s terms of use.

  • We are not responsible for failures or limitations of third‑party devices.

  • Data accuracy depends on the devices used.

  • You should check relevant device data in each device’s own platform.

6.3 Data Access

  • We access only data that you explicitly authorize.

  • We never request or use your personal credentials from other platforms.

  • You may revoke authorizations at any time.

6.4 LibreView (Abbott)

Authorized Access:

  • Integration only with your express authorization;

  • Access through a professional account under supervision;

  • Data used exclusively to personalize the educational service.

Responsibilities:

  • Abbott retains ownership of the LibreView platform;

  • Atri does not reproduce Abbott’s brand or layout;

  • Patient data are shared within a consent framework.

6.5. Specific Educational Tools

6.5.1 Carb Calculator

What it does:

  • Educational tool based on SBD (Sociedade Brasileira de Diabetes) guidelines and TACO tables;

  • Provides indicative estimates to support carb counting;

  • Supports nutritional education and meal‑routine management.

Important limitations:

  • Does not replace individualized professional nutritional guidance;

  • Values are estimates and may vary by preparation/brand;

  • Insulin dosing decisions must always follow medical guidance.

Always consult your doctor or nutritionist for specific adjustments.

6.5.2 Exam Aggregation

What it does:

  • Organizes and stores lab results;

  • Chronological visualization;

  • Integration with reports for easier medical visits;

  • Secure backup of important documents.

Important limitations:

  • Atri does not interpret exam results;

  • We do not provide medical analysis or alerts based on results;

  • Interpretation and conduct are the physician’s responsibility;

  • The tool is for personal organization and record‑keeping only.

You understand these tools are educational/organizational support and do not replace assessment and guidance by licensed health professionals.

6.6 - Devices and Services

Our service may connect to:

- Abbott LibreView/FreeStyle Libre;

- Dexcom G6/G7 (when available);

- Apple Health;

- Google Fit;

- Garmin Connect.

7. Communication via WhatsApp

7.1 Required Opt‑in

To receive WhatsApp messages, you must explicitly opt in via our site or app.

7.2 Message Types

We send messages about:

  • Educational/operational support;

  • Reminders/notifications;

  • Answers to your day‑to‑day routine questions.

7.3 Communication Rules

  • 24‑hour window: free‑form responses within 24 hours of your last message.

  • After 24 hours: only pre‑approved standard templates.

  • Clinical boundary: no medical advice or health recommendations via WhatsApp or any other channel.

7.4 Available Features

  • Automated commands ("DADOS/DATA", "DELETAR/DELETE", "SAIR/STOP")

  • Routine notifications;

  • Customer support;

  • Educational content.

7.5 Special Commands

  • SAIR/STOP: stop receiving messages.

  • DADOS/DATA: request access to your data.

  • DELETAR/DELETE: request deletion of your data.

7.6 Limitations

  • 24‑hour free‑form window;

  • Pre-approved message templates thereafter;

  • Opt‑in required;

  • Simple opt‑out via “SAIR/STOP”.

8. Care & Guidance Team

8.1 Our Care Team

When using the Services, you may opt to be contacted by our Care Team for educational support about diabetes and related topics.

This is optional and can be enabled/disabled in our WhatsApp communication with an Atri professional. Our team includes:

  • Diabetes educators for day‑to‑day routine questions.

  • CRN‑registered nutritionists for individualized nutrition guidance.

  • CREF‑registered physical educators for exercise prescriptions.

  • A consulting physician (active CRM) for medical guidance when applicable.

8.2 Nature of Support

You understand and agree that:

  • Our role is exclusively educational and routine support.

  • All health/treatment decisions are yours and your attending physician’s.

  • Our team provides educational guidance for daily management; not medical care.

  • If you have a physician on the platform, we act as tech support to them.

  • If you do not, we support education on healthy‑routine best practices.

  • Clinically relevant events may be communicated to your registered physician on the platform.

8.3 Limitations and Responsibilities

  • Our professionals do not replace your doctor.

  • Guidance is educational/routine support, not medical prescriptions.

  • You retain full autonomy over your health decisions.

  • For clinical doubts, always consult your physician.

You acknowledge that our team’s monitoring is intended to support routine management and not to replace professional medical care.

9. Commercial Services and Product Sales

9.1 Sale and Delivery of Products

By using the Services, you authorize and agree that:

  • We intermediate subscription‑based sales of diabetes‑related products (monitors, medications, supplements, etc.) through our platform.

  • Delivery is carried out via licensed pharmacy partners.

  • Invoices are issued by our pharmacy partners directly to you.

  • We are responsible for intermediation; delivery is executed by specialized partners.

9.2 Business Model

  • Curated catalog: We offer a curated selection of products from our catalog.

  • Quality Assured: All products are supplied by licensed, trusted partners.

  • Transparency: Our professionals do not recommend products and are not compensated to recommend specific items.

  • Shared Responsibility: We handle sales intermediation; partners handle the sale, logistics, and invoicing.

  • Integrated Support: We provide full support for technology-related questions and coordinate with partners regarding the products sold.

9.3 Purchase Process

Orders:

  • Via Atri platform;

  • Confirmation by email/WhatsApp;

  • Processing/delivery by partner network;

  • Tracking when applicable.

Payment:

  • Processed through our platform;

  • Accepted methods per availability;

  • PCI‑DSS compliance;

  • Financial data protected per LGPD.

9.4 Your Consumer Rights

  • 7‑day withdrawal under CDC;

  • Applicable legal/manufacturer warranties;

  • Selection within our curated catalog;

  • Full support for commercial issues;

  • Exchanges/returns per each product’s policy.

10. Privacy and Data Protection

10.1 Commitment to Privacy

The protection of your personal data is fundamental to Atri. We strictly comply with Brazil’s General Data Protection Law (LGPD) and implement best-practice security measures.

  • Transparency in data processing

  • Specific and legitimate purpose

  • Adequacy and necessity

  • Data quality and accuracy

  • Technical and organizational security

10.2 Health Data

  • Processed under LGPD;

  • Technical separation between personal data and health data;

  • Encryption and strict access controls;

  • Technical safeguards;

  • Maintained/up‑to‑date systems.

10.3 Service Improvement and Technology Development

By using our Services, you authorize and agree that:

  • Identify opportunities to improve our services

  • Develop more personalized and effective features

  • Contribute to advancing knowledge on diabetes management

  • Enhance the platform’s algorithms and functionalities

Safeguards Implemented:

  • Rigorous anonymization: We remove any information that could identify you

  • Technical separation: Personal identifiers are kept completely separate from analytics data

  • Access controls: Only authorized personnel access data for improvement purposes—and never personal data

  • Specific purpose: Data are used exclusively to improve diabetes-related services

  • Re-identification testing: Regular checks to ensure anonymization remains robust

  • Purpose limitation: Data are segregated by use case

You understand that this analysis and development process is essential for us to deliver increasingly better and more personalized services, while always respecting your privacy.

10.4 International Transfers

  • Primary Hosting: Data primarily hosted in Brazil.

  • Cross-border: ANPD Standard Contractual Clauses (SCCs) for all international processors, when required.

  • Transfer Impact Assessments: Documented for all vendors.

10.5 Your Rights

You can:

  • Access your personal data

  • Correct inaccurate information

  • Request deletion of your data

  • Receive all of your data at any time (portability)

  • Revoke specific consents

  • Request information about relevant automated decisions

11. Intellectual Property

All rights in the Services—including technology, software, design, content, and trademarks—belong to Atri or our licensors.

  • The platform’s design, layout, and interface

  • Algorithms and technical functionality

  • Brand, logos, and visual identity

11.2 Your Rights

  • You retain ownership of your personal and health data.

  • You can export your data at any time.

  • You grant us a limited license to use your data as necessary to provide the Services.

11.3 User Use

Allowed:

  • Personal use of educational content

  • Sharing your own data generated on the platform

  • Printing for personal use

Prohibited:

  • Commercial reproduction without authorization

  • Mass distribution of content

  • Modification of protected materials

  • Use of the brand or visual identity

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATRI IS NOT LIABLE FOR:

  • Medical decisions based on information from the Services

  • Failures or inaccuracies of third-party devices

  • Temporary interruptions of the Services

  • Indirect, incidental, or consequential damages

  • Issues with third-party devices

  • Interruptions of third-party services

  • Improper use of the platform by the user

12.2 Limitations

Total liability will not exceed the amount you paid in the 12 months preceding the event giving rise to the claim.

12.3 Emergencies or Health Decisions

The Services are not intended for emergencies or critical health decisions. In emergencies, seek professional medical care immediately.

13. Availability and Maintenance

13.1 Service Availability

  • Continuous platform monitoring

  • System redundancy and backups

  • Disaster recovery plans

13.2 Maintenance and Interruptions

Scheduled Maintenance:

  • Advance notice when possible

14. Modifications

15. Termination

We may suspend or terminate your account in the event of:

  • Violation of these Terms

  • Fraudulent or unlawful use

  • Non-payment for services

  • Prolonged inactivity

15.3 Effects of Termination

  • Your access to the Services will be discontinued.

  • Provisions intended to survive will remain in effect.

These Terms are governed by Brazilian law, including:

  • Brazilian Civil Code (Law 10,406/2002)

  • Consumer Defense Code (Law 8,078/1990)

  • General Data Protection Law — LGPD (Law 13,709/2018)

17.2 Venue

Forum of São Paulo, SP, to resolve disputes related to these Terms.

17.3 Severability

If any provision is held invalid, the others remain in force.

17.4 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Atri.
